Appeal of the Polissya Fund of International and Regional Research on Legislative Support of Public Initiatives

Dear future MPs!

The elections to the Verkhovna Rada of Ukraine have ended. According to the results of the will, both Chernihiv and residents of other regions, you have the honor to represent the interests of our community in the higher legislative body. I would like to believe that together with the deputy mandate you will take on all those obligations that have declared during the election campaign and will have to solve them.

The Polissya Fund of International and Regional Research as a member of the All -Ukrainian Public Coalition “Reform Support Network” appeals to you to pay attention to those public initiatives that are relevant not only for the Chernihiv community, but for the whole of Ukraine.

First of all, it is the support in the Verkhovna Rada of Ukraine developed by public experts from different regions to the draft Law of Ukraine “On Local Referendum”, the adoption of which will contribute to the development of civil society in our country.

In addition, in order to reduce corruption and economic imbalance in the development of regions, we consider it necessary to implement European principles of regulation of state aid, which are formulated on the basis of European Union legislation and aimed at supporting the development of enterprises by the state.

Principles of State Aid Regulation:

1) State aid should be aimed at fulfilling clearly defined tasks, problems of socio-economic development, which can be substantiated without receiving state assistance.

2) State aid measures must be duly developed to fulfill its tasks. The characteristics of state aid (volume, form of provision, mechanism of provision) should be adequate (proportional) of the problem to which it is directed.

3)Through state assistance, the recipient must start or carry out an activity that would be impossible without state assistance.The state assistance of the activity that the recipient will carry out in any case and to the same extent as without help is not acceptable.

4) State aid should be aimed at creating new production facilities, new jobs, technologies.

5) State aid, as a rule, should not compensate for the current expenses of business entities, especially those who work unprofitably, are under bankruptcy.

6)Results (production facilities, workplaces, etc.), achieved through state assistance, should maintain their purpose for the next few years.

7) State aid should be aimed at partial reimbursement of the cost of the project sold by the recipient.

8) The positive impact of state assistance on achieving the goals of economic development should be dominated by a valid or expected impact of a negative nature on the state of economic competition.

The implementation of these principles into domestic legislation will help lay the foundation in the formation of truly market and democratic relations of the state and subjects of economic activity.
