The results of a parallel counting of votes conducted by a support at the polling stations of the district №205 at the intermediate elections of the People’s Deputy of Ukraine


According to the parallel calculation of voter votes conducted by the OPORA Civic Network at the constituency polling stations on the basis of primary PEC protocols on the counting of voters, a candidate from the political party “Petro Poroshenko Bloc Solidarity”Sergey Berezenkogot33.59%votes who took part in the vote. The second place was taken by the candidate from the Ukrainian Patriot-Skrop Party partyGennady Korbanfrom13.81% voter votes. The third place as a result of the parallel counting was taken by the candidateVladimir tooth,which was supported by the Self -help Association (7.73%). Igor Andriychenko(Democratic Alliance) gained support7.48%voter votes. Instead, self -nominatedMykola Zverevgot7.15%voter votes. For the candidateAndriy Mishchenko, nominated by Svoboda VO, voted6.53%voters.

The results of other voter votes were distributed as follows:

  • The candidate is self-nominated, member of the Opposition Bloc PartyAlexei DemYanenko5.1%;
  • Candidate of the self-nodeAndriy Melnyk3.14%;
  • All other candidates together-11.83% vote.

Invalid3.66%ballots.

OPORA representatives worked at 82 out of 83 polling stations within the single -member constituency # 205.

Previous statement of the OPORA Civic Network on the Voting Day and the counting of votes in the intermediate elections of the People’s Deputy of Ukraine in constituency No. 205

The election campaign and the day of voting in the intermediate elections of the People’s Deputies of Ukraine in the single -member district №205 (Chernihiv) were accompanied by a number of violations of election standards and manifestations of unfair competition by candidates. The excessive role of money in the agitation strategies of candidates, disproportionate access of election participants to media resources, the readiness of the main competitors to resort to illegal actions complicated for the voters of the district of formation and implementation of free will.

A key problem in compliance with the election standards in district # 205 was the deviation of the state from its obligations to stop any violations during the election process.

Until the Day of Voting on July 26, 2015, the state’s ability to prevent violations of the legislation was questioned by a not enough active and often contradictory response of responsible bodies to the attempts of candidates to apply unlawful methods of voting.

Unfortunately, the activities of law enforcement agencies were narrowed to law enforcement and security during a campaign, voting and vote, but almost did not include effective efforts to prevent and prevent violations of the legislation. At the same time, free will of citizens is impossible without steadily fulfillment of the requirements of the legislation by the subjects of the electoral process and guaranteeing the principle of inevitability of punishment for violations.

The lack of systemic counteraction to voters, the responsibility for which was significantly strengthened in 2014, could significantly affect compliance with the conditions of free will and accordingly the results of vote voting. Competition of technologies for direct or indirect forms of bribery not only influenced the formation of electoral choice of citizens, but also demotivated part of the voters to participate in the vote. Instead, cases of abuse of administrative resources in elections, manipulation of public opinion on the access of individual candidates to state and local development programs have survived the confidence of citizens in the impartiality of the state in these elections.

With the use of the most active candidates of unscrupulous technologies, including the most financially costly, the principle of equality of opportunities could not be fully implemented.

The practice of presenting or nearby, the so -called force groups of supporting candidates who formally enjoyed the rights of representatives of print media or official observers, has become widespread on the day of voting. At the same time, cases of violation of the ballot by voters (almost 11% of the sites), which may indirectly indicate the control of the will of the citizens associated with bribery technologies, have been massive sufficiently massive.

The Opora Civic Network calls on the law enforcement agencies of Ukraine using the mechanisms of parliamentary control to conduct an objective study of violations of the legislation in the intermediate elections of the People’s Deputy of Ukraine in the constituency # 205, and the candidates are obliged to ensure comprehensive assistance to the relevant investigation.

Typical violations are recorded in the course of voting and counting votes

During the day of voting, the Opora monitored the general situation in the single -mandate constituency # 205 and the implementation of the basic election procedures by district election commissions. OPORA correspondents recorded violations and incidents that took place at 82 polling stations.

All the commissions where the activists were present held their morning meetings. However, 13% of the district election commissions arbitrarily began their preparatory meetings earlier than 7 hours. 15 min. Whereas, the Law of Ukraine “On Elections of People’s Deputies of Ukraine” establishes that preparatory PEC meetings should begin no earlier than 45 minutes before the start of voting. Thus, some PECs limited the possibilities of media and observers to cover and control the course of the morning meeting. All the DECs of the district held full -time preparatory meetings, providing the proper quorum. However, 12 % of the PEC did not conduct a protocol of the preparatory meeting, which is a mandatory requirement of the law.

Not all PECs started voting on time. According to supports, 13% of PECs opened in advance – before 8 o’clock in the morning, which is contrary to Article 85 (1) of the Law.

During the first hours of voting (from 8 to 12 hours), the most common violation of election procedures concerned the presence at the polling stations of persons who had no right to stay indoors, including people’s deputies. Such situations took place by almost 40% of polling stations. Cases of violation of voting secrecy were observed on more than 7% of PECs. While attempts to take ballots outside the site were recorded by more than 2% of PECs.

The presence of outsiders in the premises of precinct election commissions remained the most common offense between 12 and 16 hours. In particular, people’s deputies from the Petro Poroshenko Bloc Anatoliy Matvienko, Andriy Pavelko, Yuriy Solovey, Maxim Kurchy, Alexey Goncharenko, Valery Dirny from the Batkivshchyna, Andrey Lozovy from the Radical Party and the non -factional Boris Filatov were present at the polling stations. Part 3 of Article 34 of the Law on Elections of People’s Deputies of Ukraine provides an exclusive list of persons who may be present at the polling station on the day of voting without permission or invitation of the relevant commission. MPs do not include this list. Therefore, they have the right to be only at the site where they are voters, and only during the time required to exercise their will.

Also, many district sections were attended by journalists of the publication “Point of Vision”, who had falsified documents (journalistic certificates). Some of them were detained by law enforcement agencies to find out the circumstances. The support recorded the presence of people at the precinct (observers, “journalists” from the publication “Point of Vision”, trusted persons) in yellow bracelets, with the inscription “UKROP”. The indicated symbolism, which is registered with the same name, was used during election agitation by a candidate for People’s Deputies from the UKROP Party Gennady Korban.

Photographing the ballot by the voter was recorded by the support activists of almost 11% of polling stations. Repeated attempts to take photos of ballots can be a sign of the implementation of voter bribery technology, in particular an element of control over the will of citizens.

Vocational violation of voting was found on almost 10% of polling stations. At the same time, only 2 %of the polling stations attempted to take the ballot beyond the voting room. According to Art. 159 of the Criminal Code of Ukraine, a deliberate violation of the secrecy of voting during the election or referendum, which was revealed in the disclosure of the will of the citizen who participated in elections or referendum, is punishable by a fine of one hundred to three hundred non -taxable minimum incomes or correctional work.

Various forms of indirect bribery of voters who were to encourage voters to vote for one of the candidates was observed at almost 10% of polling stations. At the polling stations, unidentified persons housed tents where they handed out tickets to a concert of well -known performers. Postcards about this concert on the eve of the elections were distributed on the streets of Chernihiv in the tents of the UKROP Charitable Foundation. According to paragraph 14 of Art. 74 of the Law of Ukraine “On Elections of People’s Deputies of Ukraine”, it is forbidden to carry out election agitation, which is accompanied by the provision of voters, institutions, institutions, organizations of funds either free of charge or on preferential terms of goods (except for goods containing visual images papers, loans, lottery tickets, other tangible assets.

At the end of the voting (from 16:00 to 20:00), the largest stimulus and factor that continued to cause conflicts between the election participants was the presence of outsiders at the election commission meeting. The support has been found in almost a third (29%) of constituency polling stations.

Almost 10% of the polling stations took place cases of photographing ballots. As a result of the intervention of official observers, media representatives and members of the election commissions at individual sections, the Ministry of Internal Affairs detained the persons who committed a criminal offense.

Over the last four hours of voting, the supporters who have covered the course of the election process at the polling stations also recorded cases of violation of the mystery of voting by 6% of polling stations.

6% of polling stations revealed cases of illegal impact on the will of voters who had signs of indirect bribery of voters. Similarly, at 6% of the resuvipostal sections, the supporters were deprived of the opportunity to observe the electoral procedures, including due to improper removal from polling stations. Thus, a representative of the support at the polling station №741033 (May 1, May 1, 173) recorded a number of violations of electoral legislation, which was why the commission decided to deprive it of its right to stay in the premises for voting. An announced reason for removal – the journalist of the official edition of the support prevents the movement of voters to the booths for voting. In fact, the members of the commission committed a number of misconduct, to which the correspondent of the support paid attention. The attempt to remove the journalist of the official edition of the support from the station was also recorded at VD №741053.

Also, after the end of the voting and counting of votes, law enforcement officers kept the support activists in the premises of the polling stations and forbade to leave the PEC. This situation was recorded at sections 741028, 741026 (90987 Dotsenko St. Separate facts have submitted applications to the city administration of internal affairs of Chernihiv regarding the misconduct of police officers.

As part of the parallel counting of votes, the Opora Civic Network analyzed the data on the activity of voters in Ukraine as of 12:00, 16:00 and 20:00.

The average voter turnout at the People’s Deputy of Ukraine in the single -mandate constituency No. 205 was predicted low and was 35.2% (as of 20:00). This is 21.75 % less than in the extraordinary elections of MPs in the same district.
